TERMS OF SALE

  1. Payment in full must be made before leaving sale site. Unless stated otherwise, payment will be cash, cashier check, also by personal or company check if you have a current bank letter of guarantee to Harris Auction Service, LTD.
  2. All Lots are sold subject to sales tax unless an appropriate resale number is given.
  3. A premium of 10% will be added and is payable by the purchaser as part of the total purchase.
  4. All articles are offered "as is and where is". We make no guarantees, warranties or representations, expressed or implied, with respect to the property or the correctness of the catalog or other descriptions. No statements anywhere, whether oral or written, shall be deemed such a guarantee.
  5. Auctioneer not responsible for errors or omissions.
  6. The auctioneer reserves the right either by himself or a nominee to bid on behalf of the vendor, to withdraw, divide or consolidate any lots, and to refuse any bid.
  7. Any announcements made at the auction take precedence over any and all printer materials.
  8. The auctioneer will accept bids from any responsible and registered bidder who makes his bid known so long as he or she conducts themselves in an orderly manner.
  9. The auctioneer may refuse to accept any bid which is but a trifling advance over the prior bid or which contains conditions not acceptable to the auctioneer or seller. If any dispute arises between two or more bidders the decision of the auctioneer shall be final and absolute.
  10. Upon award of the bid, title and risk of loss, damage or destruction of the purchased item passes to the purchaser and the auctioneer shall have no liability whatsoever for any damage or destruction of such item.
  11. If any shortages exist on estimated counts, an adjustment will be made only if claims are made at the time of removal. No adjustments will be allowed after purchased items are removed from premises. The seller and auctioneer have no liability to the buyer due to the non-delivery of any purchased items.
  12. No items may be moved until settled for in manner announced. All items must be removed within time announced at the sale at purchaser's cost and risk.
  13. In the event the buyer fails to pay the entire purchase price within time set forth by the auctioneers and /or fails to comply with any of the conditions or terms of the sale, the auctioneer may retain and /or recover the deposit as the liquidated damages. The items that are not paid for will then be resold at public or private sale without further notice. The auctioneers will not be responsible for items that are not removed within specified removal period, the items shall be deemed abandoned. Auctioneer reserves the right to sue any defaulting bidder in any state of the United States of America that the auctioneer finds convenient and that the bidder does hereby consent and agree to such jurisdiction. Bidder shall be held responsible for all legal fees that may arise.
  14. Bidder acknowledges that an auction site is a potentially dangerous place. Every person at the auction site before, during and after the sale shall be there at their own risk with notice of the condition of the premises. No person shall have any claim against auctioneers, their agents, employees, principals, or sellers for any injuries sustained nor for damages to or loss of property which may occur from any cause whatsoever.
  15. All rights,privileges and power reserved or granted to the auctioneer in these terms of sale shall be deemed reserved and granted to the auctioneer's employees, advertising representatives and all owners for whom the items are being sold.
